Human Mode respects your concerns
about privacy. We want you to understand the types of information we collect,
how we use that information, how we secure it, and whether we share it. When
you use our websites, games, and applications, you agree to our collection,
use, disclosure, and transfer of information as described in this policy, so
please review it carefully. This Privacy Policy (“Policy”) applies
to Human Mode, L.L.C, (“Human Mode”), but does not apply to our
websites, games or applications that have their own separate privacy policies
or notices.
Human Mode is a global company, and
this Policy is for everyone around the world. Human Mode has to follow laws
designed to protect personal information in the many different countries where
our users live. For example, we comply with the Children’s Online Privacy
Protection Act (“COPPA”) in the U.S., the General Data Protection
Regulation (“GDPR”) in the EU, the Data Protection Act of 2018 in
the UK, and the Brazilian General Data Protection Law (“LGPD”) in
Brazil.
Human Mode is also committed to
protecting the privacy of children (i.e., users under the age of 13 under

1. ABOUT MASSIVE LOOP
Massive
Loop is developed by Human Mode, L.L.C. (“Human Mode”). To
properly participate in the Massive Loop, you must qualify as an
eligible participant under section 4 in the Massive Loop Terms of Use,
and you may be required to download, install, and use one or more of the
following “Massive Loop Software Packages” as mentioned in section
1 in the Massive
Loop Terms of Use.
2. INFORMATION HUMAN MODE COLLECTS OR
RECEIVES
Human Mode only collects, uses,
shares, stores, or otherwise processes your personal information when we have on
an appropriate basis. For example, Human Mode may process your personal
information as necessary to provide services that are subject to terms you have
accepted, such as our end user license agreements or service terms and
conditions. Human Mode may process your personal information when necessary to
comply with legal obligations or for purposes of pursuing legitimate interests,
if doing so is consistent with your rights and appropriate to the context, such
as providing services, addressing game performance, fixing bugs, performing
internal analytics, and conducting reasonable monitoring of your use of our
services to prevent misuse of our services and fraud. Additionally, Human Mode
may, in certain cases, ask you for your consent for certain processing of your
personal information.
Human Mode generally collects or
receives information in three ways: (1) you voluntarily provide information to
us, such as by creating an account, making purchases, or signing up for email
alerts, (2) we collect information automatically, such as through cookies or
our games and other software, and (3) other parties, such as social networks,
payment services, and verification services, may provide information to us.
Each of these methods is described in more detail below.
(1) Information You Voluntarily Choose
to Provide
Everyone
in Massive Loop has to create an account in order to participate in our
experiences.
When
you create a Massive Loop account, we will ask you to choose a unique username,
display name, and password. We require this information so that you can log
into your account and participate in the Massive Loop or using
Massive Loop Software Packages. We do not use usernames and display names to
identify individual users outside of their activities on our Massive Loop.
We
will also ask you for your date of birth, your email address, the location you
live in and which language you speak so we can customize your experience in
Massive Loop.
You
must not create a username that includes your real name or other Personal
Information. It is important to create a password that is not easy to guess.
You must not share your password with anyone else, not even your friends and
families.
Users
may be asked to provide or may choose to add their email address, phone number,
credit card information or photo ID for verification and/or to enable certain
features. The primary purpose for this information is to provide account
security, since this is the only way for Human Mode to check the authenticity
of an account owner. Users may change the email address associated with their
account at any time; however, a notification will be sent to the previously
provided email address upon making that change.
You may provide your personal
information to us when you choose to use Human Mode’s websites (such as humanmode.com and massiveloop.com), Massive Loop Software Packages, games,
or applications. Because we change our offerings and features from time to
time, the options you have to provide us with information also may
change. The following are some examples of situations in which you may provide
information to us:
The personal information we collect
from you will vary depending on the services you are using, the websites you
are visiting, and how you access those services and websites. The information
you provide to us may include your name, your display name, and your email
address(es). If you choose to make a purchase, we will collect payment card
information such as your card’s payment account number and expiration
date. Sometimes we ask for your name, your phone number, your postal address,
your billing address, and your date of birth.
Some of our websites also provide a
feature that supports job applications, in which case we also ask for your
resume, name, and email address. We use this information to determine if you
are qualified for the position for which you applied or to contact you to set
up an interview.
(2) Information Collected Automatically When
You Use Our Websites, Games, and Applications
We collect some information
automatically when you visit our websites or use our Massive Loop Software
Packages, games, game engines, and applications. If a combination of
information that we collect does identify you as an individual, we will treat
the combined information as personal information. We typically aggregate the
data that we collect automatically and use it in statistical form to determine
trends among groups of users, rather than using it to identify individuals.
We collect information
automatically through technologies such as web browsers, “Cookies”,
log files, web beacons, and our back-end servers collect usage data transmitted
from our games and other software. We use the information for purposes such as
modifying or improving features, managing advertising, addressing technical
issues, preventing fraud or misuse of our services, and conducting data
analytics. A Cookie is a small text file that allows us to remember your
actions and preferences on the website (such as your login details, your
language settings and your font size preference) over a period of time so you
don’t have to re-enter them whenever you come back to the website or
browse from one page to another. We will also remember your favorite games and
friends.

features on our website are provided by third parties, those third parties may
also use automated means of data collection and may record information about
your use of our website or others’ websites over time. These features are
subject to those third parties’ privacy notices and policies.
(3) Information We Receive from Others
In some cases, other parties
provide us with information about you, or allow us to collect information about
you. We generally collect or receive information from other parties in four
ways: (1) you use our Massive Loop Software Packages, games or applications
using a website or device that is not controlled by us, such as a game console
or social network, (2) you choose to use a social feature of our Massive Loop Software
Packages, games or applications, (3) you purchase one of our Massive Loop
Software Packages, games or applications from another party, or (4) you use our
Massive Loop Software Package, games that contain or require anti-cheat
services from other parties. In some cases, we are not able to control the
amount or type of information that other parties like social networks, make
available to us. In those cases, we use only the data that we need to provide
the types of services we think our users want and expect. Although we cannot
control your privacy settings at those websites or how those other parties
protect your privacy, once we receive information about you through those
websites, we will treat it in accordance with this policy.
When You Use Our Massive Loop Software
Packages, Games and Applications at Third Party Websites
When you use any Human Mode game,
application, or feature at a website not controlled by Human Mode, such as a
social network, that website may allow Human Mode access to certain information
about you. For example, social networks may provide us with information from
your profile on their website such as contact information, demographics, and
other information you provided to that website such as your photo, user name,
and potentially any and all information that you agreed the social network or
other party could provide to us when you use our games and applications.
When You Use Social Features of Our
Games and Applications
When you choose to use a social
feature of our games and applications, you allow Human Mode to receive
information about you from social networks. Our social features promote and
facilitate interaction among players, such as by allowing you and your friends
to work together to meet a shared challenge presented by our game or
application. You may be able to use these features to find out if your friends
are actively playing the game and using the feature, to find out if they used
it in the past, and to invite them to join you to meet a game challenge.
If you choose to use one of our
social features, you may be asked to log into a social network through our game
or application. The social network may then provide Human Mode with information
such as your social network user ID, your profile picture, and the user IDs and
profile pictures of your connections.
When You Buy Massive Loop Software
Packages, Games and Applications from Other Parties
We may also receive information
about you from the organizations that sell our Software Packages, games or
applications, or which provided the gaming system you use. Those parties may
provide us with information regarding your account or registration, but they do
not give us your payment information. Because those organizations determine
what information they will collect from you, it may vary according to their
services, but it is likely to include information such as your name, email
address, user ID, location, and date of birth.
When You Use Massive Loop Software
Packages, Games that Contain or Require Anti-Cheat Services from Other Parties
Certain of our games contain or
require third party anti-cheat services. These services may collect and analyze
data about the game binary or your computer to detect cheating and may share
some of this information with us. However, these anti-cheat service providers
perform anti-cheat analysis independently of Human Mode or its subsidiaries and
therefore are independent controllers of the data that they collect from you.
If cheating is detected, these service providers will provide information to
Human Mode that is necessary to identify the relevant account. In addition, the
service providers may make available to Human Mode
information to evidence the
detected cheating.
3. HOW WE USE AND SHARE INFORMATION
As a general matter, we use your information
to provide the services, experiences, merchandise, or information you request.
We also may use your information for the following purposes.
· To communicate with you, respond to
your requests, or provide you with updates and information;
· To better understand our users,
their interests, and their preferences;
· To personalize your experience,
save your preferences, authenticate our users, and provide similar
user-experience features;
· To develop, deliver, and improve
our products, services, and other offerings, some of which may be offered in
partnership with other parties;
· To manage and customize
advertisements or promotional offers;
· For security purposes;
· For internal purposes such as
auditing and data analysis.
3. To the extent you give consent,
such as when we would like to process your personal information for a purpose
that would otherwise be incompatible with this policy.
We store personal information for
as long as we reasonably need it to fulfill the purposes for which it was
collected. For example, if you register for our services and create an account,
we will store your information for as long as needed to maintain your account,
provide the services you requested, enforce any applicable terms that govern
your use of the services, and maintain appropriate records to reflect our
delivery of services to you. We periodically review the personal information we
retain to determine whether continued storage is proper. We may share, or
provide you with opportunities to share, information about you with other users
of our websites, games, game engines, and applications as described in this
policy. We also provide services that allow our users to communicate with Human
Mode and each other, in which case personal information may be shared and
account IDs may be displayed.
We may share personal information
we collect within our family of companies. We also will share information with
service providers that perform services on our behalf and under our
instructions. These service providers are not authorized by us to use or
disclose the information except as necessary to perform services on our behalf
or comply with legal requirements. We also may share certain limited
information, such as device identifiers, with advertisers and other marketing
partners for purposes of gauging the effectiveness of advertising and other
marketing strategies.
We may share information about you
with your social network contacts when you and they use the same social
features of our games and applications.
We may also disclose information
about you: (i) if we are required to do so by law, legal process, or a
reasonable request from law enforcement authorities or other government
officials, (ii) when we believe disclosure is necessary or appropriate to
prevent physical harm or financial loss or in connection with an investigation
of suspected or actual illegal activity, or (iii) if necessary to protect the
vital interests of another individual (such as to prevent death, bodily harm,
or serious damage to property). We reserve the right to transfer information
about our users in the event we sell or transfer all or substantially all our
business or assets.
YOUR CHOICES
We provide you with choices about
whether to provide us with personal information and whether it is shared. For
example, we may seek your prior consent for certain processing. We are required
to seek your consent before we use your personal information for any purpose
incompatible with the purposes identified in this policy. You may withdraw your
consent at any time by sending an email as specified in the “How to
Contact Us” section below. Any withdrawal of consent is only effective on
a going-forward basis and will not impact processing we undertook while relying
on your consent.
We generally only ask you for
personal information that is necessary to provide the services you request. You
can choose not to give us the personal information we request, as described in
the “Information You Voluntarily Choose to Provide” section of this
policy. However, in some cases, if you decide not to provide the personal
information we request, we will not be able to provide the game, application,
service, information, or features you requested.

4. ACCESS, CORRECTION, AND DELETION OF
YOUR PERSONAL INFORMATION
We provide you with the ability to
request access to and correction and deletion of your personal information. You
can update your account information any time through Massive Loop’s
website. If you would like to request access to or correction or deletion of
your personal information, please submit your request by sending an email to
the address specified in the “How to Contact Us” section below.
Please include your name, email address, and postal address in your request,
and describe specifically the information that you would like to access, correct,
or delete so that we may respond appropriately and promptly.
5. HOW WE PROTECT PERSONAL INFORMATION
We maintain appropriate
administrative, technical, and physical safeguards to protect your personal
information from accidental, unlawful, or unauthorized destruction, loss,
alteration, access, disclosure, or use and other unlawful forms of processing.
In some cases, your information is accessible when you log into a feature we
offer, and in those cases you need to keep your user credentials and
password confidential and secure so that your information is protected.
The security of your information is
important to us. We have measures in place to protect it against loss, misuse,
or tampering. However, no security measures are 100% effective, so we cannot
guarantee against these risks.
6. INFORMATION SHARING
Human Mode does not sell your
information to other companies for them to use as they want.
Human Mode have relationships with
some companies that help us provide our services (for example, when you pay for
a subscription), so we may provide some of your information to them, but only
because we need to in order to complete your transaction.
We also hire other people and
companies to perform services for us. The other companies are only allowed to
use the personal information we share with them to complete tasks that we hire
them to do. They are not allowed to sell your personal information or use it
for their own purposes.
Public forums and community areas
There are some areas in Massive
Loop such as in game chat where you can communicate with other
Massive Loop users. These are public places and anything you share in these
areas is available to other Massive Loop users who can access the same places.
You should remember this before you post any information in these public areas.
As you know, Massive Loop wants to create a safe space for all its users, so we
do not allow you to share any personal information about yourself such as your
name, where you live, or your email address.
7. EXTERNAL LINKS
Sometimes you may find a link to
another company’s website on our websites or app. We are not responsible
for that company’s privacy policies or content. If you are being directed
to another site, we may display a warning message to give you a heads up.
8. CHILDREN’S PRIVACY
As a user you are entitled to
additional protections for your information and privacy online. When you
register an account with Massive Loop, we make sure your account is
set to a restrictive mode, which means that you won’t have access to
certain features, such as the ability to speak, if you are not 18 or over and
your text filtering will be restricted. These additional measures are in place
to keep you as safe as possible online.
Human Mode does not direct its
websites, games, game engines, or applications to children (usually considered
to be under the age of 13, depending on the country where you reside). We also
do not intentionally collect personal information from children through our
websites, games, game engines, or applications. If you are the parent or
guardian of a child and you believe that we have inadvertently received
personal information about that child, please contact us as described in the
How to Contact Us section of this policy and we will delete the information
from our records.
9. STORAGE AND INTERNATIONAL TRANSFER
OF YOUR PERSONAL INFORMATION
Human Mode stores your information
in the United States.
The privacy laws of the United
States may not be as strict as those in your country (especially if you live in
the EU or the UK), but we take reasonable steps to protect your information and
your privacy rights.
10. YOUR PRIVACY RIGHTS IN CALIFORNIA
If you live in California, you may
have additional rights when it comes to your information. You can ask us to:
· Give you a copy of the personal
information we have collected about you in the last years;
· Fix your personal information if it
is incorrect;
· Delete some of your personal
information;
· Refrain from selling or sharing
your personal information for cross-context behavioral advertising purposes;
and
· Request us to stop using your
information in some situations.
YOUR PRIVACY RIGHTS IF YOU LIVE IN
THE EEA, UK OR SWITZERLAND
If you live in the EEA, the UK or Switzerland,
you may have additional “rights” when it comes to your personal
information. You can ask us to:

11. ADDITIONAL INFORMATION FOR USERS IN
BRAZIL
If you are a resident of Brazil,

If you live in Brazil, you may have
additional “right” when it comes to your personal information. You

13. UPDATES TO OUR PRIVACY POLICY
This policy may be updated
periodically to reflect changes in our personal information practices or
relevant laws. We will indicate at the top of this policy when this policy was
last updated. Please review this policy every time you access or use our websites,
game engines, games, or applications to make sure that you have reviewed the
most recent version.
If we make any major changes, we
will let you know by email (if we have your email address) or by showing a
prominent notice on this website or in app prior to the change becoming
effective.
